These terms are an agreement between you and Harley James Auer, a sole trader trading as ASCND ("ASCND", "we", "us", "our"). By using the ASCND website at tryascnd.app, joining the waitlist, or using the ASCND app once it launches, you agree to these terms. If you do not agree, please do not use the service.
ASCND is a fitness app, launching soon, that uses AI to give you an estimate of your physique, an indication of your stronger and weaker areas, and a suggested training focus. It is intended for general fitness and motivation only. It is not medical, health, nutritional, or professional fitness advice, and it is not a diagnosis. Always seek advice from a qualified professional before making decisions about your health, training, or diet.
ASCND is for adults aged 18 and over. By using it, you confirm that you are 18 or over.
Joining the waitlist means we will email you about ASCND, mainly to tell you when it launches. We do not promise a specific launch date, and our plans may change. You can unsubscribe at any time using the link in any email, or by emailing support@tryascnd.app.
Scores and feedback from ASCND are estimates produced by AI. They may be inaccurate or incomplete, and they are not a measure of your worth, your health, or your value as a person. Do not rely on them for any health, medical, or safety decision. If anything ASCND shows you affects how you feel about yourself, please talk to someone you trust or a qualified professional.
You agree to use ASCND only for yourself, and only with images you have the right to use. You agree not to misuse the service, attempt to break or interfere with it, or use it for any unlawful purpose. You must not upload images of anyone who has not agreed to it, and you must not upload images of anyone under 18.
Photos you submit remain yours. When the app launches, to produce your score you give us permission to process those images through our AI provider to generate your result. As set out in our Privacy Policy, your images will not be stored by us once your score has been produced.
The ASCND name, brand, design, and software are owned by us. You may not copy, resell, or reuse them without our permission.
ASCND is provided on an "as is" and "as available" basis. We do not guarantee that it will always be available, uninterrupted, or free of errors, and we may change or withdraw features.
To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or reliance on, ASCND or its estimates. Nothing in these terms limits any liability that cannot be limited by law.
We may update these terms as ASCND develops. The date at the top shows when they were last changed. If you continue to use ASCND after a change, you accept the updated terms.
These terms are governed by the laws of England and Wales, and any disputes will be subject to the courts of England and Wales.
